Your Legal Right to Choose Your Doctor

Under 5 U.S.C. § 8103 of the Federal Employees' Compensation Act, you have the absolute statutory right to select your own treating physician. You are never required to treat with your agency's clinic.

Direct DOL / OWCP Billing Coordination

Our office coordinates billing directly with the Department of Labor under established FECA fee guidelines for authorized evaluations and accepted conditions, handling documentation on your behalf.

Core Clinical Services

Specialized FECA / OWCP Medical Care

Unlike general clinics that treat federal paperwork as an afterthought, every evaluation, diagnostic test, and medical report we generate is crafted specifically to meet the evidentiary standards of the U.S. Department of Labor.

01 Claim Acceptance

Initial Medical Evaluations & Causation Narratives

Initial claim approval requires probative medical evidence that satisfies the Department of Labor. We provide thorough clinical evaluations and rationalized physician narratives that clearly bridge the work incident to your diagnosis.

  • Form CA-1 (Traumatic Injury) & Form CA-2 (Occupational Disease) support
  • Clear medical etiology, mechanism of injury, and clinical rationale
  • Timely documentation to support Continuation of Pay (COP) and CA-7 wage loss
02 Expanded Coverage

Condition Expansions & Consequential Injuries

Work injuries often cause secondary trauma—such as altered gait damaging knees or spine, or complications from chronic pain. We document the medical nexus required to expand accepted conditions on your OWCP file.

  • Objective evaluations identifying consequential physical and neurological changes
  • Supplemental narrative causation reports petitioning OWCP for condition expansion
  • Protecting coverage for necessary procedures, diagnostics, and ongoing therapies
03 Core Specialty

Schedule Award Ratings (AMA Guides 6th Edition)

When an accepted work injury leads to permanent functional impairment, federal law provides statutory monetary Schedule Awards. We perform meticulous impairment ratings structured to withstand District Medical Advisor (DMA) review.

  • Determination of Maximum Medical Improvement (MMI)
  • Evaluations conducted strictly under the AMA Guides 6th Edition
  • Comprehensive rating narratives formatted to avoid claims examiner rejections
04 Care & Transition

Duty Status, Treatment Coordination & Accommodations

From safe return-to-work restrictions to specialized diagnostic testing, we protect your health while managing the medical documentation your agency and OWCP require for long-term stability.

  • Form CA-17 Duty Status Reports and enforceable physical work capacity restrictions
  • Coordination for advanced imaging (MRI/CT), neurodiagnostics, and therapy
  • DME authorizations, leave buyback documentation, and FERS disability medical reports

The Medical-Legal Standard

Why Good Medicine Alone Isn't Enough for the DOL

Standard primary care physicians and emergency room doctors are exceptional clinicians, but they are rarely trained in the exacting evidentiary standards of the Federal Employees' Compensation Act.

A claims examiner at the Department of Labor cannot approve benefits based simply on an exam note stating "injured at work." OWCP requires probative, rationalized medical opinion that fulfills five strict criteria:

  • Timely Filing: Proof that the claim was submitted within statutory FECA deadlines.
  • Federal Employment Status: Establishing you were in the performance of duty as a covered employee.
  • Fact of Injury: Corroborating that the specific physical event actually occurred at work.
  • Performance of Duty: Demonstrating the event occurred within the scope of your federal assignment.
  • Causal Relationship (The Key Hurdle): A comprehensive physician explanation detailing with reasonable medical certainty how the mechanics of the work event produced your exact diagnosis.

At M&D Federal Diagnostics, we know precisely what OWCP claims examiners and District Medical Advisors (DMAs) look for—ensuring your paperwork is accurate, complete, and legally compelling from the start.

Claimant FAQ

Frequently Asked Questions

Clear answers to common questions about federal workers' compensation and our services.

How does billing work for federal workers' compensation evaluations?

For covered federal workers' compensation claims under FECA/OWCP, authorized medical evaluations, narrative reports, diagnostic testing, and treatment coordination are billed directly to the U.S. Department of Labor according to established federal fee schedules.

Our records office coordinates directly with OWCP and your claim file so you don't have to manage complex workers' comp paperwork and billing on your own.

Can my supervisor force me to go to the agency's company doctor?

No. Under 5 U.S.C. § 8103, every federal employee has the guaranteed statutory right to choose their own treating physician. While an agency may direct you to an occupational clinic for emergency first aid or a formal fitness-for-duty exam, they cannot mandate where you treat for your ongoing FECA workers' compensation claim.

My claim was previously denied. Can M&D Federal Diagnostics help me?

Yes. Most FECA claim denials are not caused by a lack of injury—they occur because the initial medical report lacked the specific legal-medical causation language required by the Department of Labor. We review past denial notices, identify the evidentiary deficits, conduct an in-depth clinical evaluation, and produce the rationalized narrative report required for reconsideration.

What is a Schedule Award, and how do I know if I qualify?

A Schedule Award is a monetary benefit paid under the Federal Employees' Compensation Act for the permanent partial or total loss of use of a specified anatomical member (such as an arm, leg, hand, foot, eye, or hearing). You become eligible once your injury has reached Maximum Medical Improvement (MMI). Our team conducts meticulous impairment rating evaluations strictly using the AMA Guides to the Evaluation of Permanent Impairment, 6th Edition.

What documents do I need to provide for my first evaluation?

To ensure our clinical team can build a compelling file, please have available:

  • Your OWCP Claim Number (if already assigned)
  • Copies of Form CA-1, CA-2, or CA-16 previously submitted
  • Any decision letters, development letters, or denial letters from OWCP
  • Prior diagnostic reports (MRI, X-ray, CT) and treatment records
  • A current position description or summary of regular physical job duties

Note: In accordance with our security protocols, medical records should be dropped off in person or sent by physical mail to our records office.
